Morocco has modernized its land registration laws, providing foreign investors with a secure, highly regulated, and straightforward process for acquiring freehold real estate.
1. Freehold Title Security (Titre Foncier)
Unlike some Middle Eastern or Asian markets that restrict foreigners to leasehold agreements, Morocco allows foreigners to own land and buildings on a **freehold basis**.
Every legitimate property in Dakhla is registered with the National Agency for Land Conservation (ANCFCC). Once a purchase is finalized, the buyer’s name is recorded on the "Titre Foncier" (Title Deed). This registration represents absolute, state-guaranteed ownership that cannot be contested.
2. The Crucial Role of the Notary
All real estate transactions must go through a licensed Moroccan Notary (Notaire), who acts as a neutral legal officer. The notary is legally responsible for verifying that the seller has clean title, that the property has no outstanding debts or mortgages, and that the funds are held securely in escrow (Caisse de Dépôt et de Gestion - CDG) before transfer.
3. Step-by-Step Purchasing Process
The typical acquisition process takes between 30 and 90 days:
- Reservation Agreement (Compromis de Vente): Signed by both parties, establishing the price and conditions. A deposit (typically 10%) is paid into the notary's escrow account.
- Due Diligence: The notary checks the land registry for liens, utility permits, and title validity.
- Final Deed (Acte Authentique): Signed in front of the notary after the remaining balance and fees are transferred.
- Registration: The notary registers the deed at the ANCFCC, issuing the new Title Deed in the buyer's name.
